Dulos appeared before Judge John Blawie on Monday, Sept. 23 after probation officials noticed the system’s power dipped below 25 percent on at least four occasions in the last month.
His attorney, Norm Pattis said the monitoring is not even needed or required because Dulos is not charged with a violent crime.
Fotis Dulos, 52, and his former lover, Michelle Troconis, 44, are each free on bail after being charged twice with tampering with evidence and hindering prosecution in connection with the Friday, May 24 disappearance of Jennifer Dulos in New Canaan.
Others matters heard during the appearance included the judge denying Pattis’ request for Fotis Dulos to attend the deposition of Troconis who has been subpoenaed in a civil lawsuit filed by Jennifer Dulos’ mother, Gloria Farber.
The judge cited the no-contact order in the criminal case. Blawie did say Fotis Dulos could view the deposition, scheduled for Wednesday, Sept. 25, by closed-circuit monitoring.
Blawie also agreed to hear arguments on Friday, Oct. 4, on Pattis' motion to dismiss the charges.
Jennifer Dulos has been missing since she was last seen dropping off her children at school.
